In response to escalating security concerns for air cargo across Europe and North America, Transport Canada has introduced stringent new regulations impacting cargo transported on passenger flights arriving from various European international origins. As per Transport Canada’s directive SMIAC-Europe-Asia-29 Aug 2024, effective immediately, shipments destined for Canada must adhere to the following key conditions:
1. Business Relationship Requirement
Cargo from the listed countries will only be accepted if it is shipped by parties with an established business relationship with either the airlines, their freight forwarders, their Known Agents, or as Known Consignors.
This relationship is defined as having an active account or documented payment history for at least 90 days before the issuance of the SMIAC directive(i.e., since at least May 31, 2024), and must include a minimum of six shipments within this 90-day timeframe.
2. Challenges for EXW Shipments
Shipments under EXW (Ex Works) terms present a unique challenge, as these transactions often lack an active account or documented payment history with local freight forwarders due to the nature of the Incoterm.
